Legal Protection For Wisconsin’s Domestic Abuse Survivors
Domestic violence is one of the most traumatic experiences that anyone could endure. If you have experienced it in your previous or current relationship and need protection, we can help you.
At Benske Family Law, we work with individuals and families throughout Wisconsin who have survived domestic abuse. We can also help you if you face accusations of domestic abuse that could jeopardize your criminal record and your custody arrangement with your children. In either situation, our team of experienced attorneys is ready to provide the personalized legal service you need for protection.
How Do Restraining Orders Work?
When you petition for a restraining order, the court will either grant or deny a temporary order. In Wisconsin, there are four types of restraining orders:
- Domestic violence
- Harassment
- Child abuse
- Individual at risk
If you’re granted a restraining order, a police officer will serve the respondent with the documents, and the order will last for two weeks. Then, the court will schedule a hearing at the courthouse. You and the responder have the right to appear and present your evidence before the court. Then, the judge can decide whether to issue an injunction – a restraining order that lasts for a longer period of time.
